In 1955, Joseph Fallek represented Alfred Aresco, a first generation American who was denied a position with the NYPD because his non-English speaking father once signed a nominating petition for a local candidate who, unbeknownst to the father, was affiliated with the communist party. With Joe Fallek as his counsel, Aresco sued the NYPD. The court rejected the concept of “guilt by kinship” and ordered the Police Commissioner to reconsider his decision. Alfred Aresco was appointed as a police officer.
Our lawyers have been litigating employee rights ever since. Andrew Fallek successfully argued in both federal and state court that employers may not use information learned from confidential employee counseling programs to discipline employees. See Jeanette A. v. Condon, 728 F. Supp. 204 (S.D.N.Y. 1989) and Matter of City of New York v. O’Connor, 9 A.D.3d 328 (1st Dep’t 2004). We have also been counsel in many of the major cases involving public sector disability pensions.
